WITHIN THE SCOPE OF LAW ON THE PROTECTION OF PERSONAL DATA NO. 6698 PRIVACY NOTICE

a) Data Controller and Representative

As MOBİLİZ BİLGİ VE İLETİŞİM TEKNOLOJİLERİ A.Ş. (hereinafter referred to as “Company”), we process your personal data in accordance with Law on the Protection of Personal Data No. 6698 (hereinafter referred to as “LPPD”) in the scope described below and within the limits prescribed by the LPPD and other related legislation.

In this respect, your personal data shall be acquired, recorded, stored, maintained, changed, re-arranged, disclosed, transferred, taken over, made available, classified, transferred to third parties or institutions by means of wholly or partly automated, or, on the conditions to be a part of a filling system, non-automated means.

b) Personal Data Processing Purposes 

Your personal data shall be processed within the personal data processing conditions specified in the Articles 5 and 6 of the LPPD for the purposes of performing of the necessary activities to ensure you benefit from the products and services offered by our Company; of suggesting the products and services offered by our Company by customization in accordance with your needs; of planning and/or performing of the market research activities for the sales and marketing of products and services; of planning and/or performing of the after-sales support service activities; of monitoring contract processes and/or legal requests; of providing legal, technical and commercial safety of the persons involved in the business relationship; of the performing of human resources policies of our Company, of making evaluations in case of your application for employment, of fulfilling our statutory and legal obligations in case of your employment; of ensuring quality monitoring of our products and services; of tracking of supplied products; of providing your security when you visit our Company, of identifying your identity and of ensuring your connection to the wireless network; of contacting you if you request information or product demo from our Company; of performing of the sale or service contract when you purchase a product or service; of planning, auditing and performance of information security processes; of creation and management of information technology infrastructure; of performing of finance and/or accounting activities; of performance of legal affairs; of planning and performing of Company activities; of planning and performing of corporate communication activities; of planning and performing of logistics activities; of determination and implementation of commercial and business strategies of our Company.

c) To Whom and For What Purpose the Processed Personal Data can be Transferred 

Your personal data may be transferred to our business partners, suppliers, shareholders, affiliates, legally authorized public authorities and private individuals in accordance with the personal data processing requirements and purposes set out in Articles 8 and 9 of the LPPD for the purposes of performance of the necessary activities to ensure you benefit from the products and services offered by our Company; of suggesting the products and services offered by our Company by customization in accordance with your needs; of conduction of the collection process of our Company; of performance of human resources policies of our Company; of ensuring legal and commercial security of our Company and the persons/entities that have business relations with our Company; of determination and implementing of commercial and business strategies of our Companies. 

Legally authorized intermediary payment institutions that we receive support from in collections, Law No. 6493 on Payment and Securities Settlement Systems, Payment Services and Electronic Money Institutions, Law No. 5549 on Prevention of Laundering Proceeds of Crime, Law No. 6415 on Prevention of Financing of Terrorism, No. 7262 on Mass Destruction, collects and stores the bank and/or credit card information of our customers in line with the payment legislation consisting of the Law on the Prevention of the Financing of the Non-Proliferation and secondary regulations. We remind you that payment institutions are separate data controllers in these processes.

d) Transfer to Other Countries

Your personal data is not transferred to other countries and kept in our domestic data center. In our communications with electronic mail, your personal data in the content and annexes of the message are processed in our electronic mail systems abroad. Even if it becomes necessary to keep your personal data in other countries in the future, your data shall always be kept in countries that the Personal Data Protection Board deems appropriate.

e) Method of Collecting Personal Data and Legal Justification

Your personal data are collected to improve the products and services that we offer and to conduct our commercial activities within the commercial purpose framework of our Company with various channels and on the basis of various legal justifications by using the methods of your contact with our Company via diverse ways; of conclusion and performance of a contract between our Company and you; of your visit our Company; of transfer of your information by third persons to contact with you for commercial activity; of information sharing in the organizations such as fair, training, conference; and similar methods. Your personal data collected for these legal justifications may be processed and transferred for the purposes specified in articles (b) and (c) of this Privacy Notice within the scope of the personal data processing requirements set forth in the Articles 5 and 6 of the LPPD.

f) Retention Period of Your Personal Data

In the event that the justification for their process is disappeared, your personal data that we processed in accordance with the LPPD shall be deleted, destroyed or anonymised by our Company in accordance with the provisions of the Regulation on the Erasure, Destruction or Anonymisation of Personal Data and other legislation, on our own motion or upon your request. Our responsibilities in the scope of all kinds of legislation principally the Turkish Commercial Code No. 6102, Turkish Code of Obligations No. 6098, Labor Law No. 4857, Law on Occupational Health and Safety No. 6331, Law on Regulation of Publications on the Internet and Suppression of Crimes Committed by Means of Such Publications No. 5651 are reserved.

g) Your Rights and Application under Article 11 of the LPPD

As the data subject, within the scope of Article 11 of the LPPD, you have the rights;

• to learn whether your personal data is processed,
• to request information regarding the process if your personal data is processed,
• to learn the processing purpose of your personal data and whether they are used in line with the purpose,
• to know the third parties at home and abroad to whom your personal data is transferred,
• to request the rectification of your personal data if it is processed incompletely or incorrectly, and this rectification made in this regard is notified to third parties whom your personal data is transferred,
• to request your personal data is deleted and destroyed even if they are processed in accordance with the LPPD and other relevant laws and legislation in the event that the justification for their processing is disappeared, and this process performed in this regard is notified to third parties whom your personal data is transferred,
• to raise an objection against the emergence of a result detrimental to you with the analysis of processed data using exclusively automated systems,
• to request that your damage is indemnified in the event that you are damaged because of the unlawful processing of your personal data.

Pursuant to the Article 11 and the paragraph 1 of the Article 13 of the LPPD and the Communiqué on the Procedures and Principles of Application to the Data Controller, you can submit your request in order to use your above-mentioned rights (preferably by filling in the application form on our website providing relevant information) directly to our Company at the address of Mustafa Kemal Mah. 2127.Sok. No:42/1-2 Çankaya Ankara or via public notary in written or registered mail in order to be able to identify your identity and not to provide information to irrelevant persons, or via our Registered Electronic Mail (the “REM”) of mobiliz (at) hs01 (dot) kep (dot) tr, or by sending an electronic mail to the address of kvkk (at) mobiliz (dot) com (dot) tr using your secure electronic signature, mobile signature or via (if any) your electronic mail that was previously notified to our Company and registered in our systems, or via other methods to be determined by the Personal Data Protection Board.

Your application must include;

a) Name, surname and, if the application is in written, signature, 

b) T.R. ID number of the citizens of the Republic of Turkey, the nationality, passport number and, if they have one, ID numbers of foreigners,

c) Domicile or workplace address available for the notifications, 

d) If you have, electronic mail address, telephone and fax number available for the notifications,

e) The subject of the request, 

You should also add the information and documents related to the subject into your application.

Within scope of the rights granted in the Article 11 of the LPPD, in the event that as the data subject you send your requests regarding the afore-mentioned rights, our Company shall respond as soon as possible and within thirty days at the latest. If the request requires making an additional cost, we inform you that our Company may charge a fee in the fee tariff determined by the Personal Data Protection Board. The response to your application shall be given by our Company under all formal and procedural conditions in compliance with all of our responsibilities within the scope of the LPPD and the Communiqué on the Procedures and Principles of Application to the Data Controller.
